1. About these terms
These terms apply when you access or use thebluedot.com.au and its content. By using the website, you agree to them. If you do not agree, please stop using the website.
2. Business identity
Blue Dot Production is operated by Blue Dot Productions Pty Ltd, ABN 65 685 281 145. In these terms, “Blue Dot Production”, “we”, “us” and “our” refer to Blue Dot Productions Pty Ltd.
3. Website information only
The website provides general information about our production capabilities, crew, projects and resources. It is not a production contract, final quote or legal, financial, funding, safety or technical advice.
Every project is subject to its own scope, quote and production agreement. If these terms conflict with an accepted project agreement, that project agreement applies to the project.
4. Enquiries and bookings
Submitting an enquiry does not create a client relationship, reserve a date or require either party to proceed. A project becomes binding only when the applicable quote or agreement has been accepted and any stated booking conditions, including a deposit where required, have been satisfied.
5. Project agreements
Production work is governed by the contract or terms attached to the approved quote. Project-specific terms may cover payment, cancellation, rescheduling, approvals, revisions, licensing, intellectual property, confidentiality, insurance, safety, production risks and delivery.
6. Portfolio and collaborator disclosure
Projects displayed on this website may have been produced or created with clients, contractors, collaborators, partner production companies or other rights holders. Some work is clearly identified as selected work by a Blue Dot collaborator rather than a Blue Dot production.
Displaying a project does not mean every aspect was completed solely by Blue Dot Productions Pty Ltd. Rights and credits belonging to clients, filmmakers, artists and other third parties remain with their respective owners.
7. Website intellectual property
Unless otherwise stated, the website design, writing, branding, graphics and original material created by us are owned by or licensed to us and protected by applicable intellectual-property law. You may view the site and share links for ordinary reference. You must not reproduce, modify, scrape, republish, distribute, sell or commercially exploit its content without permission, except where law permits.
8. Acceptable use
You must not use the website unlawfully or fraudulently; attempt unauthorised access; introduce malicious code; interfere with security or operation; place unreasonable automated load on the website; submit false, abusive or unlawful material; or infringe another person’s privacy, confidentiality or intellectual-property rights.
9. Accuracy and availability
We aim to keep the website accurate and useful, but do not promise that every item will always be complete, current or error-free. Projects, credits, availability and service information may change. We may change, suspend or withdraw parts of the site and do not guarantee uninterrupted or fault-free access.
10. Third-party services and links
The website includes Vimeo players and links to third-party sites and services. Those providers control their own content, availability, terms and data handling. A link or embed does not make us responsible for the third party’s systems or content.
11. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010, including the Australian Consumer Law.
12. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising only from use of, inability to use, or reliance on general website information. This does not apply where liability cannot lawfully be excluded or limited, and does not replace the liability provisions in an applicable project agreement.
13. Privacy
Our Privacy Policy explains how we handle personal information. Our Cookie and Tracking Notice explains essential technologies, optional analytics and embedded media.
14. Changes
We may update these terms. The current version and effective date will remain published here. Updated terms apply to later website use.
15. Governing law
These terms are governed by the laws of New South Wales, Australia. Subject to rights that cannot be excluded, the courts of New South Wales have jurisdiction over disputes relating to these website terms.
